Experts respond to President Duda's veto on the election law

This week, President Andrzej Duda vetoed the so-called "incidental law," which caused disappointment among the ruling coalition's politicians.

Adrian Witczak of the opposition accused Duda of supporting the ruling party's narrative, arguing that the legitimacy of elections should be decided by an independent court, not political appointees.

In response, experts have proposed relying on constitutional provisions to ensure the validity of elections.

Alternative plan proposed by experts

According to Rzeczpospolita, legal experts have proposed an alternative plan if the president's veto stands.

Legal scholars recommend relying on the constitution, particularly Articles 129 and 45, to establish a constitutionally valid Supreme Court setup and excluding "neo-judges" from the decision-making process. They also propose that elections should be presumed valid until a court potentially invalidates them.
