There are also new rules regarding purchases made during showcases and excursions, according to the prawo.pl website, Polish state news agency PAP reported.
All these changes come into effect on January 1, 2023, as part of an amendment to Poland’s consumer rights law, enacted last month, prawo.pl said.
Agreements signed during product/service showcases
Under the new rules, agreements signed during product/service showcases will be treated as agreements signed outside the premises of the company.
This means that the entrepreneur must notify the consumer, in clear and comprehensible terms, about the details of the agreement, prawo.pl noted.
Meanwhile, the consumer may withdraw from the agreement within 30 days of its being signed, without having to state their reasons, according to the website.
New rules for financial-services agreements
Also under the new regulations, agreements regarding financial services can no longer be signed during a product/service showcase, nor during a trade excursion, prawo.pl reported.
The only exception concerns agreements signed during product/service showcases organised at the consumer’s place of residence or permanent stay, upon their clear invitation.
An agreement signed in violation of this rule will be null and void, prawo.pl stressed.
Greater transparency of online shopping
The website noted that entrepreneurs would now face the challenge of having to disclose more information, for instance to state clearly if a given seller on an online marketplace is an entrepreneur, which would give the consumer the right to withdraw from an agreement without stating their reasons.
Moreover, entrepreneurs will be obliged to notify the consumer about the distribution of duties regarding an agreement signed on the online platform with a third party, prawo.pl noted, as reported by the PAP news agency.
